These Terms of Service ("Terms") govern your access to and use of GymUp (https://gymup.ai), an AI-powered strength coaching platform available on web and mobile. By creating an account or using the service, you agree to be bound by these Terms. If you do not agree, do not use GymUp.

1. Acceptance of Terms

By accessing or using GymUp, you confirm that:

  • You are at least 16 years of age.
  • You have the legal capacity to enter into these Terms.
  • You agree to comply with all applicable laws and regulations.

If you are using GymUp on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Service Description

GymUp is an AI strength coaching platform that generates personalized, periodized training programs based on evidence-based volume science and real coaching methodology.

GymUp is a paid product. A single GymUp Pro subscription unlocks the full coach:

  • AI coaching chat to adjust programs, swap exercises, and ask training questions.
  • Personalized program generation (evidence-based, periodized), with progression and deloads managed for you.
  • Save, edit, and reschedule training programs.
  • Log workouts and track your full training history.
  • Athlete profile, body metrics, and personalized memories.
  • Exercise library, performance analytics, and periodization context.
  • MCP integration to connect compatible AI clients to your training data.

The annual plan starts with a 3-day free trial (see Section 6). GymUp also provides an MCP (Model Context Protocol) integration that allows compatible AI clients to access your training data and the exercise library programmatically.

3. User Accounts

To use GymUp, you must create an account using either email (via one-time password verification) or Google sign-in.

You are responsible for:

  • Maintaining the security of your account credentials.
  • All activity that occurs under your account.
  • Providing accurate and up-to-date information.

One account per person. GymUp reserves the right to suspend or terminate accounts that violate these Terms or are used fraudulently.

4. Acceptable Use

You agree to use GymUp only for lawful, personal fitness purposes. You must not:

  • Reverse-engineer, decompile, or attempt to extract the source code of the service or its AI models.
  • Scrape, crawl, or systematically extract data from the platform beyond what is provided through the MCP integration.
  • Abuse, manipulate, or attempt to circumvent usage limits, rate limits, or subscription restrictions.
  • Redistribute AI-generated training programs commercially without prior written permission.
  • Impersonate another person or misrepresent your affiliation with any entity.
  • Use the service to transmit harmful, abusive, or illegal content.
  • Interfere with or disrupt the service or its infrastructure.

5. Intellectual Property

GymUp owns the service, its AI models, the exercise library, training methodology, coaching data, and all related intellectual property.

You own your personal data, including your workout logs, body metrics, chat history, and athlete profile information.

AI-generated programs are provided to you under a personal, non-exclusive, non-transferable license. The underlying training methodology and coaching intelligence remain the property of GymUp.

By using the service, you grant GymUp a limited license to process your data solely to provide and improve the service.

6. Subscription and Payment

GymUp is available as a paid GymUp Pro subscription in two plans (prices shown for the United States; app store pricing is auto-derived for other territories):

  • Monthly: $9.99 per month, billed immediately.
  • Annual: $69.99 per year (save 42% versus paying monthly), starting with a 3-day free trial. You are not charged until the trial ends; cancel before it ends and you pay nothing.

Key terms:

  • Payment processing: Subscriptions are purchased through the mobile apps and processed by the respective app stores (Apple App Store, Google Play Store).
  • Auto-renewal: Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. After the 3-day trial, the annual plan renews at $69.99 per year until cancelled.
  • Cancellation: You may cancel your subscription at any time through your app store subscription management. Cancellation takes effect at the end of the current billing period.
  • Refunds: No partial refunds are provided for unused portions of a subscription period. Refund requests are subject to the policies of the applicable app store (Apple or Google).
  • Price changes: GymUp may adjust subscription prices with reasonable advance notice. Existing subscribers will be notified before any price change applies to their next billing cycle.

7. AI Disclaimer

GymUp provides AI-generated fitness coaching for informational and educational purposes only.

  • GymUp is not a certified personal trainer, physiotherapist, or medical professional.
  • AI-generated recommendations are not a substitute for professional medical advice, diagnosis, or treatment.
  • You should consult a qualified healthcare provider before starting any exercise program, particularly if you have pre-existing medical conditions, injuries, or health concerns.
  • GymUp is not liable for any injury, health issue, or adverse outcome resulting from following AI-generated training recommendations.
  • AI responses are generated based on training data and coaching methodology. They may not account for your individual medical conditions or physical limitations that have not been disclosed to the system.

By using GymUp, you acknowledge that you exercise at your own risk.

8. Limitation of Liability

The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by law:

  • GymUp shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.
  • GymUp's total liability for any claim arising from or related to these Terms shall not exceed the total amount you paid to GymUp in the twelve (12) months preceding the claim.
  • GymUp does not guarantee uninterrupted or error-free service. The platform may experience downtime for maintenance, updates, or unforeseen technical issues.

9. Termination

By you: You may delete your account at any time through your account settings. Upon deletion, your access to the service will cease and your personal data will be handled in accordance with our Privacy Policy.

By GymUp: We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or use the service in a way that harms other users or the platform. We will make reasonable efforts to notify you before or promptly after taking such action, unless doing so would compromise security or legal obligations.

Upon termination, any active subscription will not be renewed, but no refund will be issued for the remaining period.

10. Changes to Terms

GymUp may update these Terms from time to time. When we make material changes:

  • We will update the "Last updated" date at the top of this page.
  • We will notify you via email or in-app notification.
  • Your continued use of the service after the changes take effect constitutes acceptance of the updated Terms.

If you do not agree with the updated Terms, you should stop using the service and delete your account.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of France. Any disputes arising from or relating to these Terms or the service shall be submitted to the exclusive jurisdiction of the courts of France.
